Abstract: In a number of cases, parties do not choose or agree on the substantive law governing their dispute neither in their contract or otherwise due to various reasons. In such cases, the arbitral tribunal is required to select the applicable substantive law. The power of arbitral tribunal to decide upon the question of applicable law is recognized almost in all arbitration rules and laws worldwide. This chapter discusses the various approaches provided under relevant provisions of UNCITRAL and ICSID documents.
