Protection and Awareness of Indian E-Consumers: An Analysis

Abstract

The fast growing Indian digital economy requires protection of rights of the consumers. The consumer transactions on online platforms in India has experienced substantial growth because of the robust expansion of e-commerce industry. The article provides a detailed understanding of the current laws safeguarding e-consumer in India and also explains the aspects of rights and awareness of the e-consumers. The government has safeguarded the interests of the Indian e-consumers under the Consumer Protection Act, 2019 and the e-consumer protection rules, 2020. The article with the use of doctrinal methodology highlights the Indian e-consumers essential rights equivalent to the fundamental rights of the constitution of India, including the right to access, right to information, right to privacy, and the protection of their personal data. The article using empirical methodology analyses lack of awareness about e-consumer rights and laws in India and gives an insight regarding the consumer buying behaviour on digital platform as well as consumer awareness at large. Collaborative efforts between government agencies, consumer protection organizations, and e-commerce platforms are crucial in enhancing awareness through educational campaigns, workshops, and user-friendly resources. The article tries to evaluate a roadmap so that policymakers and industry stakeholders should mutually develop robust mechanisms for e-consumer protection that can efficiently address disputes and safeguard the interests of online shoppers.
