Abstract: The onset of industrial revolution saw the beginning of the development of the law of trademarks, as this was the period of mass production and distribution of good and services. Emergence of industrial revolution coupled with competitive market economy, the sellers or manufacturers started recognizing their products with various symbols and marks to distinguish their products from the other similarly placed products in the market. This led to the advent of advertising aiming to create a clear demarcation between the products. The main tool used in the advertising process were the trademarks which helped in acquiring reputation and goodwill and promoting the products with a distinctiveness.
